FL Baby Marketplace respects the intellectual property rights of others and expects users of our services to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, we may remove or disable access to material that we believe, in good faith, infringes copyright, and we may terminate repeat infringers.

Reporting Copyright Infringement

If you believe that material available on or through our services infringes your copyright, please send a written DMCA notice to our designated copyright contact with the following information:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
• Identification of the copyrighted work claimed to have been infringed;
• Identification of the material claimed to be infringing, including enough detail for us to locate it;
• Your name, mailing address, telephone number, and email address;
• A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may send us a written counter-notification containing:

• Your physical or electronic signature;
• Identification of the material that was removed or disabled and the location where it appeared before removal;
• A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
• Your name, address, telephone number, and email address;
• A statement that you consent to the jurisdiction of the federal district court for your address, or if outside the United States, any judicial district where FL Baby Marketplace may be found, and that you will accept service of process from the person who submitted the original DMCA notice.

After receiving a valid counter-notification, we may restore the removed material within 10 to 14 business days unless the original complaining party files a court action seeking to restrain the alleged infringement.
